1. Definitions

• "Store," "we," "us," or "our" refers to aviasonline.ca and the company AVIAS.

• "Website" refers to aviasonline.ca.

• "You" or "Customer" refers to the individual or entity using the Website and/or purchasing products from us.

• "Products" refers to the technology products sold on our Website.

• "Consumer" refers to an individual acting for personal, family, or household purposes, as defined by the Consumer Protection Act, 2002.

2. Acceptance of Terms

These Terms constitute a legally binding agreement between you and aviasonline (AVIAS). By clicking "I agree" or by using the Website and placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms.

3. Online Store Terms

• By agreeing to these Terms, you represent that you are at least the age of majority in the Province of Ontario.

• You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws).

• A breach or violation of any of the Terms will result in an immediate termination of your access to our services.

4. Products and Services

• We sell technology products that are subject to availability.

• All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

• All prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes, including the Harmonized Sales Tax (HST) in Ontario and other provinces where applicable.

• We make every effort to display the colours and images of our products as accurately as possible, but we cannot guarantee that your device's display of any colour will be accurate.

• We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

5. Order and Payment

• All orders are subject to acceptance by us. We reserve the right to refuse any order for any reason.

• The final price of your order, including all shipping and handling charges, and applicable taxes, will be clearly disclosed to you before you are asked to finalize your purchase.

• All shipments are on a prepay and ship basis. Your order will not be processed or shipped until we have received and cleared the full payment.

• We use third-party payment processors to handle all transactions. We do not store your credit card information. Your payment information is subject to the terms and conditions and privacy policy of the third-party processor.

6. Shipping and Delivery

• We ship products via courier to locations within Canada. We do not ship to P.O. boxes.

• All shipments are subject to our aviasonline (AVIAS) Shipping Policy, which is incorporated into these Terms by reference.

• Under the Consumer Protection Act, 2002, if we fail to deliver the goods within 30 days of the specified delivery date (or within 30 days of the agreement if no date was specified), you may have the right to cancel the agreement and receive a full refund, unless you have expressly agreed to a later delivery.

7. Returns and Refunds

• All returns and refunds are subject to our aviasonline.ca  Return and Refund Policy, which is incorporated into these Terms by reference.

• Nothing in this section is intended to limit your rights under the Consumer Protection Act, 2002, including your right to a refund for defective goods or services that are not of a "reasonably acceptable quality."

8. Intellectual Property

• All content on this Website, including text, graphics, logos, images, and software, is the property of aviasonline.ca or its content suppliers and is protected by Canadian and international copyright and intellectual property laws.

• You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or its content without our express written permission.

9. Limitation of Liability

• In no case shall aviasonline.ca, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost data, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services or any products procured using the service.

• This limitation of liability does not apply to any liability that cannot be excluded or limited under the Consumer Protection Act, 2002, or any other applicable law in Ontario.

10. Indemnification

• You agree to indemnify, defend, and hold harmless aviasonline.ca and our parent AVIAS, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law and Jurisdiction

• These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

• You agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario in the event of a dispute.

12. Changes to Terms

• We reserve the right to update, change, or replace any part of these Terms by posting updates and changes to our Website. It is your responsibility to check our Website periodically for changes. Your continued use of or access to our Website following the posting of any changes constitutes acceptance of those changes.

13. Severability

• In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
